Pre-existing conditions

Summary

Pre-existing condition exclusions are no longer applied to members covered under health insurance policies and group health plans. These rules apply equally to collectively bargained and non-collectively bargained plans.

Grandfathered group health plans receive no special protection and must comply once the provision becomes effective with respect to the plan.

This provision does not apply to individual health plans that are grandfathered.
